Access Aiken County Court Records

Aiken County Court records in South Carolina are split among trial courts, county offices, summary courts, detention records, and statewide judicial portals. Aiken County Court case search usually starts with the official public case systems, then moves to the Clerk of Court, Probate Court, Traffic Court, Magistrate Court, Municipal Court, or Sheriff when a record is not online. Search for Aiken County Court cases by matching the record type to the office that keeps it, because a criminal case, traffic citation, estate file, divorce decree, jail booking, and warrant can follow different access paths.

Aiken County Court System

South Carolina places Aiken County in Judicial Circuit 2 with Bamberg and Barnwell Counties. The Circuit Court is the main county-level trial court for major civil and criminal cases. Its civil division is the Court of Common Pleas, while its criminal division is the Court of General Sessions. Family Court is a statewide trial court for divorce, custody, support, adoption, termination of parental rights, name changes, and juvenile matters. Probate Court handles estates, marriage licenses, guardianships, conservatorships, trusts, commitments, and related files.

Aiken County also uses Magistrate Courts and Municipal Courts. Magistrates issue warrants, set bond, conduct preliminary hearings, hear traffic and misdemeanor cases within summary jurisdiction, and handle civil cases up to $7,500. Municipal Courts hear city ordinance, municipal criminal, and traffic matters inside city limits. Appeals from Probate, Magistrate, and Municipal Courts can move to Circuit Court. Appeals from trial courts generally move through the South Carolina Court of Appeals and then the Supreme Court of South Carolina.

What Aiken County Records Show

A court record usually shows enough information to identify the case, the court, the parties, and the current or final status. The exact fields depend on the court. Probate Search shows case number, case name, party, case type, filing date, county, appointment date, creditor claim due date, and status. Detainee records show booking and charge details, while C-Track appellate records can show events, basic case information, and many event-related documents for eligible appellate matters.

Aiken County Public Access Rules

South Carolina public access law starts with the right to inspect, copy, or receive electronic transmission of public records unless an exemption or other law applies. S.C. Code Section 30-4-30 allows reasonable actual-cost fees and gives response timelines for written public-record requests. Court records also carry judicial access rules, portal limits, and case-specific sealing orders. A public-body record and a judicial case record may not follow the same route.

The state Judicial Branch also provides Rule 610 judicial-record request information. Probate records have their own statutory duties under the Probate Code, including required court records and certified copies after fees. Juvenile records, sealed matters, adoption records, mental-health proceedings, and sensitive identifiers are restricted or redacted under South Carolina law.

Key access rules: S.C. Code Section 30-4-30 covers public-record access, S.C. Code Section 63-19-2010 protects juvenile court records, and S.C. Code Section 62-1-305 requires Probate Court records and certified copies after required fees.

The office supports Circuit and Family Courts, collects fees and fines, creates copies of legal instruments, administers jury selection, and links users to Court Case Info and Court Rosters. General Sessions is on the third floor of the Judicial Center, Family Court and Child Support are on the first floor, and the Clerk directory entry lists the second floor as the main Clerk location.

The Aiken County Clerk of Court page is the local hub for case-info links, rosters, forms, jury-line instructions, and office details.

Aiken County Court Dockets

A docket is the case activity log or the court schedule. Aiken County separates the Public Index from Court Rosters, so a person looking for a hearing date should check the roster portal as well as the case record. Post-conviction relief rosters from the South Carolina Attorney General show how official rosters can include time, applicant, docket number, attorneys, witnesses, status notes, SCDC number, county, and institution.

The Aiken County Court Rosters portal is the official roster source linked by the Clerk.

Aiken County court docket rosters

Roster access matters because the docket entry in a case file and the court calendar for an upcoming term are related, but they are not the same record.

Aiken County Traffic Records

Aiken County Traffic Court hears traffic cases for highway patrol, county officers, Wackenhut, and some USC Aiken traffic cases. Online payment is available for tickets received in unincorporated Aiken County through South Carolina Judicial Branch payment tools. The Traffic Court office is in the Simons Building at 223 Park Ave SW and has separate hours and courtroom rules from the main Judicial Center.

The Aiken County Magistrates page explains the county summary-court role for warrants, traffic, misdemeanor tickets, civil paperwork, and Bond Court.

Aiken County traffic court and magistrate records

Magistrate routing is important for Aiken County traffic records because tickets, warrants, bond events, and summary criminal matters often point to a specific magistrate or Central Traffic Court.

Aiken County Probate Records

Aiken County Probate Court is led by Judge Tonya L. Marchant and sits in Room E126 of the Judicial Center. Probate handles estates, wills, marriage licenses, guardianships, conservatorships, trusts, commitments, minor and wrongful-death settlements, and related matters. Aiken Probate retains original estate records from 1904 to present. The South Carolina Department of Archives and History retains original estate documents from 1873 through 1903, while Aiken Probate has microfilm copies for public viewing.

The Aiken County Probate Court page gives the local court function and contact point.

Aiken County probate court records

Probate records should not be searched only through the general case index because estate and marriage-license records follow the Probate Court and South Carolina Probate Search path.

Current detainee lookup is handled through the official county Detainee Public Search.

The Aiken County Sheriff's Office website is the official public-safety source for jail, records, visitation, mail, commissary, phone, and app information.

Aiken County inmate records Sheriff's Office

The Sheriff's Office source is separate from the Clerk's court files: jail profiles and incident reports can help identify an arrest, but they do not prove conviction or replace the court case record.

Aiken County Warrant Records

No official countywide Aiken County Sheriff's Office active-warrant search portal was located in the research. The county warrant path is court and agency based. Magistrate Courts issue area warrants. Municipal Courts may issue municipal and failure-to-appear warrants. North Augusta publishes an official municipal warrant web app, but the city warns that information is limited and should be verified with the agency before action.

Bond Court is tied to the Detention Center at 435 Wire Road. Bond hearings are held twice daily on weekdays and on weekends or holidays, with separate payment cutoff times. A person with an unresolved warrant should verify the issuing court or agency and may need legal counsel before appearing in person, because law enforcement may arrest on a confirmed active warrant.

Note: Aiken County warrant checks should use official court, sheriff, municipal, or public-safety contacts rather than third-party warrant websites.

Restricted Aiken County Records

Some Aiken County records are public only in part, or not public at all. Juvenile court records are confidential under South Carolina law and generally require court authorization for access. Sealed and expunged records do not appear in ordinary public portal searches. Adoption files, mental-health commitment records, and sensitive personal identifiers can be restricted or redacted. The Public Index no longer displays home address information for new and existing cases as of January 1, 2026.

Expungement requests for eligible criminal records move through the Solicitor process. The Aiken County Solicitor materials list a non-refundable Solicitor administrative fee, SLED verification fee, and possible Clerk filing fee when applicable, and the process may take 10 to 12 weeks. Dismissed Magistrate or Municipal charges after June 2, 2010 may need to be expunged through the court that disposed of the charge.

Federal records are not searched in the Aiken County Public Index.

The District of South Carolina Aiken courthouse page identifies the local federal courthouse and inquiry path.

Federal civil, criminal, bankruptcy, and agency matters use federal court systems such as PACER, CM/ECF, the U.S. Bankruptcy Court, and federal agency sources rather than Aiken County offices.

Aiken County Records Fees

Aiken County fees depend on the custodian and record type. Public Index searching itself had no official fee located in the research, but certified copies, probate copies, marriage copies, background checks, and expungement filings have separate cost rules. Do not assume one office's fee applies to another office. Probate Court, Sheriff's Records, the Solicitor, and the Clerk each handle different transactions.

Aiken County Court History

Aiken County materials state that the original courthouse was built in the late 1800s, and the current Judicial Center was renovated and expanded in 1984. That history matters for records because older estates, municipal dockets, and paper files may not live in the same systems as modern online case records. For example, Aiken Probate keeps original estate records from 1904 forward, while estate documents from 1873 through 1903 are held by the South Carolina Department of Archives and History.

The county's official homepage remains the broad entry point for county offices, hours, departments, and public links.
