Aiken County Circuit Court Overview
South Carolina Circuit Court is the state's court of general jurisdiction. It has two divisions: Court of Common Pleas for civil matters and Court of General Sessions for criminal matters. Aiken County is in Judicial Circuit 2 with Bamberg and Barnwell Counties. Circuit Court also has limited appellate jurisdiction over appeals from Probate Court, Magistrate Court, and Municipal Court.

How a Case Moves Through the Aiken County System
Circuit Court case flow changes by division. A civil matter over $7,500 moves through Common Pleas at the Judicial Center. A higher-level criminal case moves through General Sessions, with early bond, warrant, and first-appearance issues often touching Magistrate Court, Bond Court, the Clerk, and the Solicitor before a final Circuit Court disposition.

Civil, Criminal, and Family Divisions
Common Pleas is the civil side of Circuit Court. Aiken County's research identifies civil matters over $7,500 and selected other cases as Common Pleas matters at the Judicial Center. The Clerk supports recordkeeping and judgment recording for these case files.
General Sessions is the criminal side of Circuit Court. The Solicitor prosecutes individuals charged with crimes carrying potential punishment of more than 30 days confinement and/or more than $1,000 in fines. Records may include indictments, warrant numbers, charges, first-appearance materials, rosters, docket entries, plea documents, sentencing orders, and bench-warrant activity if a defendant fails to appear.

Family Court is not a Circuit Court division, but it shares the Aiken Judicial Center and Clerk support structure. It is the exclusive forum for marriage, divorce, legal separation, custody, visitation, termination of parental rights, adoption, support, alimony, marital property division, name change, and most juvenile matters.
Magistrate and Municipal Court Roles

Aiken County Magistrate Courts handle warrants, bond, preliminary hearings, small claims and civil matters up to $7,500, traffic cases, and misdemeanor offenses within summary jurisdiction. Aiken, Midland Valley, New Ellenton/Jackson, North Augusta, and Wagener/Monetta Summary Courts issue warrants for criminal offenses in their respective areas.
Municipal Courts hear city ordinance violations and offenses inside the municipality punishable by up to a $500 fine or 30 days imprisonment, or both. They do not have civil jurisdiction. Aiken Municipal Court and North Augusta Municipal Court appear in SC Judicial Branch municipal availability lists for Public Index or traffic ticket systems, but not every city or town court record in Aiken County should be assumed searchable online.
Probate Court and Circuit Appeals

Aiken County Probate Court handles marriage licenses, estates, guardianships, conservatorships, minor settlements, involuntary commitments, trusts, and concurrent power-of-attorney matters with Circuit Court. Appeals from Probate Court can move to Circuit Court, but Probate records themselves are searched through Probate Court and the SC Probate Search rather than through the Aiken Public Index alone.

The county Clerk page links Court Case Info to that Public Index and Court Rosters to the Aiken roster portal. Statewide notices say cookies and JavaScript must be enabled and some browsers may require a pop-up exception for case detail.
For certified copies, official judgment records, or records missing from the online portal, use the Clerk of Court at 109 Park Avenue SE. For Probate or marriage-license records, use Probate Court. For assigned summary or municipal matters, use the specific Magistrate or Municipal Court. For federal cases, do not use the Aiken Public Index.
Federal Court Is Separate
Aiken County is in the U.S. District Court for the District of South Carolina. The federal Aiken location is the Charles E. Federal civil, criminal, bankruptcy, tax, benefits, federal prison, and federal civil-rights matters are not in the Aiken County Clerk's Public Index. Use federal systems and the Columbia Clerk's Office when the case belongs to the District of South Carolina.

That distinction prevents a common search error: a county Circuit Court record is searched through South Carolina state and local court channels, while a federal record is searched through federal court channels.
Courthouse Access Notes
The county describes the Judicial Center / Courthouse as separate from the Aiken County Government Center at 1930 University Parkway. Court records, Circuit Court, Family Court, Probate Court, and Clerk of Court services are centered at Park Avenue, while many administrative county services are at University Parkway. The original courthouse was built in the late 1800s, and the current Judicial Center was renovated and expanded in 1984.
Accessible parking and an accessible entrance are available at the main public entrance in the parking area nearest the church. If a visitor is not sure where to go, county lookup materials say to stop by the Service Center on the second floor or call 803-642-1500 during regular business hours. County hours on the government site are generally Monday through Friday, 8:30 a.m. to 5:00 p.m., excluding holidays.
